We have occupational therapy experts who undertake Functional Capacity Evaluations to determine an individual’s capability to undertake their job. (NB We do not have any associates who are occupational health doctors). Following a comprehensive assessment a detailed report will be written on the findings, with conclusions and recommendations. A broader based vocational assessment can also be undertaken with recommendations for vocational rehabilitation.
Reports can be provided, not for litigation purposes, but to investigate a complaint and issues raised in respect of a particular Trust and to provide opinion on any evidence in support of the claim and to identify any steps that should or could have been taken.
Occupational therapists are able to write reports on housing needs for disabled individuals in relation to local authority allocations and priorities.
Goods should be “Fit for Purpose” (Consumer Rights Act 2015). Disabled people purchase equipment to aid their independence, comfort and safety; much of this is extremely expensive and may have been sold without the benefit of proper assessment of need and appropriateness. Our occupational therapists can assess the fitness for purpose and write a report on findings.
Occupational therapy experts can provide reports in relation to disabled adults affected by discrimination in the workplace.
Our experts can provide reports in relation to challenges to ECHPs (occupational therapists, physiotherapists and/or speech and language therapists).
Reports can be provided in respect of prisoners / defendants with disabilities, and their needs related to care and activities of daily living.
Examples of family court casework include assessments of parents with disabilities, and assessments of the needs of disabled children where family courts are involved.
All our experts are fully trained in the role of the expert witness and the Civil Procedure Rules, as well as extended training to cover medico-legal report writing, experts’ meetings, answering part 35 questions and courtroom skills.
Liability experts are fully conversant with the necessary legal tests – Bolam, Bolitho and Montgomery, and other relevant tests for different jurisdictions. Quantum experts are cognisant of the principles of reasonable restitution.
